What is meant by Judge Recusal?

Judge Recusal refers to the removal of the judge from considering the case before him if there is a legal reason that casts doubt on his impartiality and integrity. The recusal is initiated through a request made by one of the parties to the case, and specific legal procedures must be followed to ensure the validity of the recusal request.

In contrast, there is a distinction between recusal and disqualification:

  • Judge Recusal: The judge is initially qualified but there are circumstances that prevent him from continuing to hear the case. 
  • Disqualification: A legal condition that renders the judge unfit to hear a specific case due to a loss of impartiality, without the need for any specific procedures.

Purpose of Judge Recusal

The system of judge recusal aims to:

  • Achieve justice and enhance the impartiality of the judiciary.
  • Protect the judge from frivolous claims.
  • Strengthen litigants’ confidence in the judicial system.

Cases of Judge Recusal According to the Civil Procedures Law

The legislator outlined the cases for judge recusal in Article 100 of the Civil Procedures Law as follows:

1- If the judge or his spouse has a similar case 

  •   The two cases must be identical in facts or subject matter.
  •   The dispute must not be fabricated for the purpose of recusing the judge.

2- Existence of a dispute between the judge or his spouse and one of the parties

  •  The dispute must have arisen after the case was filed, without the intention of influencing the judge.

3- A dispute between a relative of the judge or his ex-spouse and one of the parties

  • The judge must have an ex-spouse and children from that marriage.
  • The dispute must be ongoing before the court.

4- If one of the parties works for the judge or has been in regular social contact with him

  •    “Social contact” refers to living in the same place (e.g., the same apartment or house).

5- Existence of animosity or affection between the judge and one of the parties

  •    Animosity or affection must affect the judge’s impartiality.

Regulations to Minimize This Case

The legislator has established several mechanisms to minimize recusal cases:

1- Judge’s Disclosure

  • The judge must inform the court in the advisory chamber of the reason for the recusal and request permission to withdraw from the case.
  • In the case of a sole judge, the matter is referred to the Chief Justice of the judiciary.

2- Judge’s Self-Perception of Bias

  • The judge is allowed to withdraw if he feels biased in considering the case.
  • This requires the approval of the court in the advisory chamber or the Chief Justice of the judiciary.
